If you have a Trust and overseas beneficiaries there are some important issues you need to be aware of if you plan on allocating them income or a capital distribution.
With new AML/CFT Legislation that came into effect on 1st July, Enterprise Angels on behalf of EA Nominee Ltd and EA GP Ltd must undertake Customer Due Diligence on all investing entities including individuals, Companies, Partnerships, Societies and of course Trusts.
In working through devising our new Client Agreements to capture all necessary information, we discovered that there are situations where allocations from a Trust may be taxed when it is not income.
We strongly recommend that you talk to your lawyer and/or accountant to ascertain if your legal entity is in fact the best option for investments, especially if you have children living overseas, or are part of a blended family.
